Lasting Powers of Attorney

A Lasting Power of Attorney lets you appoint someone to make decisions for you. This might be if you're unavailable or not able to make decisions. A Lasting Power of Attorney is a must for everyone. They may seem easy to make, but it's a legal document requiring legal advice from an expert. Here at Linley James we have the author of the Law Society's textbook on Lasting Powers of Attorney. Call us and speak to the person who wrote the textbook about making your Lasting Powers of Attorney for you. Call us now and let the solicitor who wrote the textbook make yours today.

Deputyships

If someone lacks mental capacity they are not able to make a lasting power-of-attorney. What you can do for them, to safeguard and protect them is to make a deputy ship application to the Court of Protection. This allows you, as the appointed deputy to make decisions on behalf of someone lacking capacity. To make a deputy ship application is a legal process requiring expert knowledge. Linley James has experts who are themselves appointed as deputys and understand the pros and cons of making a deputy application and being a deputy. Contact us now to create your deputyship.

Challenging Attorneys and Deputys

Most Attorneys and deputys act with integrity, some don't. The authority granted to them gives them control over someone's finances and health issues. This is what can go wrong - they fail to carry out their duties. They exploit or abuse the vulnerable adult. Fail to act in accordance with the Mental Capacity Act 2005 principles. Fail to comply with requirements of a court order. To challenge them we need evidence they have; acted, are acting, or propose to act in way which is not in the vulnerable adults best interests. Call us to discuss this further to protect vulnerable adult.

Probates and Intestacy

When someone dies hopefully they die with a will. The will is followed and the beneficiaries receive the gifts. If someone hasn't made a will they die intestate. If there is no will this can create further problems, which we can resolve. Probate is the process of sorting out a will or intestacy. It might be selling someone's house and distributing the proceeds. Giving specific gift to beneficiaries or charities. It's also dealing with inheritance tax and capital gains tax which might arise. Contact us now so we can start sorting out your probate problem and managing the tax implications.

Safeguarding & Vulnerable Adult Abuse

Safeguarding we believe is an essential feature of caring for elderly and vulnerable adults. It's ensuring they receive the care they need, no one is taking an advantage of them or financial abusing them and protecting them and their assets. Some people to take advantage. They do empty their bank accounts. They do place them in care homes and walk away. They do persuade them to make decisions which are not in the best interests. Here at Linley James we can help sort out these problems and claim recompense to protect the vulnerable adult. Speak to us now to protect your vulnerable adult.

Acting as your Attorney or Deputy

If there is no one else to manage someone's finances or make decisions for them, one of our solicitors can be appointed to assist. If you know a elderly person or vulnerable adult who needs assistance. This might be acting as their attorney or deputy. Or it could be working with the family and another decision maker. Having a lawyer as an Attorney or Deputy brings legal expertise. We understand how to make decisions on behalf of vulnerable adults to ensure the best interests are always represented. Call us now to appoint one of our solicitors as your attorney or deputy.

Wills & Trusts

At some point we should make a will. A will lets you say where you'd like your hard earned assets to pass to. If you die without a will, that is intestate your assets could go in all sorts of directions, including to people you've never met or even the ones you don't like. It's never too late to make a will. Sometimes we meet people who are at the point of dying and make wills for them. However, we'd would rather meet you for a chat over tea or coffee about your will. Contact us now to make your will.

Business Audits and Succession Planning

If you run a business you need to know how well it's performing. You need to know where things can be improved to grow your efficient business. Every business needs a business audit, and it needs one every year. If you don't have an audit, interestingly you'll never know what you're missing out. An audit lets you see what's going on and how you can improve. We provide business audits and reviews to help your business grow. We will also review your business succession planning. (Succession planning manages if something happens to a business owner). Call us now and book an appointment for your business review.

Contracts

Coming to an agreement in today's world is an essential ingredient. Getting the terms and conditions right is often harder. It's possible to have verbal agreements, but it's better if it's write down. However if the contract's not precisely drafted, there's the risk of someone being taken advantage of. This might be in advertently or sometimes someone looks for loopholes to exploit a situation. We  provide contracts for a variety of situations, service contracts, personal or business contracts, monetary arrangements or business to business contracts. If you've got an existing contract we're happy to review it to look for those loopholes. Call us now to discuss your contractual needs.

Free Aftercare for a Year

We draft Lasting Powers of Attorney and make Deputyships applications to the Court of Protection. This means that the person appointed under these authorities can make decisions on behalf of someone else. That someone else may lack capacity. This means the decision maker needs to knows what they're doing. To assist them, if we draft a Lasting Power of Attorney or make a Deputyship application, we offer a free one year's after care service. The Attorney or Deputy may contact us for information about operating their Lasting Powers of Attorney or being a Deputy. We do have an in-house expert who wrote the Law Society's textbook on Lasting Powers of Attorney now in its 4th edition.
